Terms of Service

These Terms of Service (the "Terms") are a legal agreement between you and NewBuildsFinder ("NewBuildsFinder," "we," "us," or "our") governing your use of the website at https://thenewbuildsfinder.com and the application at https://app.thenewbuildsfinder.com (together, the "Service").

By accessing or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

NewBuildsFinder is a platform that connects homebuyers, agents, builders, lenders, inspectors, and insurers around new construction inventory. The Service includes new build search and mapping, saved properties and alerts, professional profiles, pipeline and client-management tools, and — for agent users who choose to enable it — email features that send messages and surface replies through a connected Gmail account.

Listing and builder information on the Service is provided for convenience; availability, pricing, and specifications are set by the builders and may change without notice.

You must be at least 18 years old to use the Service. When you register, you agree to provide accurate, current, and complete information about yourself and to keep it up to date. You may register directly or by signing in with your Google account.

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at info@newbuildsfinder.com if you suspect unauthorized use of your account.

You agree to use the Service lawfully and responsibly. You will not:

• Violate any applicable law, regulation, or third-party right.
• Scrape, crawl, or bulk-harvest listings, user data, or other content from the Service, by automated means or otherwise.
• Interfere with or disrupt the Service, probe or bypass security measures, or reverse-engineer any part of the platform.
• Use the email features to send spam, unsolicited bulk email, or deceptive or misleading communications. You are responsible for complying with applicable messaging laws (including CAN-SPAM) for emails you send through the platform.
• Impersonate any person or entity, or misrepresent your affiliation, credentials, or the origin of your communications.
• Upload or transmit malware, or content that is unlawful, harmful, or infringing.

Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

We only access Google data to provide the features you request: authenticating you when you sign in with Google, sending the emails you initiate through the platform from your connected Gmail account, and delivering replies to those threads back to you. We do not transfer or sell Google user data to third parties, and we do not use Google user data for advertising. You can review the policy at developers.google.com/terms/api-services-user-data-policy, and you can revoke our access at any time at myaccount.google.com/permissions. The Service, including its design, software, text, graphics, and logos, is owned by NewBuildsFinder and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms.

You retain ownership of the content you submit to the Service (such as profile information and messages). You grant us a non-exclusive license to host, process, and display that content solely as needed to operate and provide the Service. Listing data, photos, and trademarks belonging to builders or other third parties remain the property of their respective owners.

Your use of the Service is also governed by our Privacy Policy, which describes what information we collect, how we use and share it, and the choices you have. By using the Service, you consent to those practices.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that listing information — including pricing, availability, and specifications — is accurate or current. Always verify details directly with the builder. Nothing on the Service constitutes real estate, legal, or financial advice.

To the maximum extent permitted by law, NewBuildsFinder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising from these Terms or the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you breach these Terms, if your use creates risk or legal exposure for us or other users, or if we discontinue the Service. Upon termination, your right to use the Service ends, and we will handle your data as described in the Privacy Policy. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and governing law — survive termination.

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date above. For material changes, we will also notify you by email or through a prominent notice in the Service. Your continued use of the Service after the revised Terms take effect constitutes acceptance of them.
